1. Our Services

The platform provides an AI-driven voice platform that enables users to resolve tasks at scale through intelligent automation. Services comply with applicable jurisdictional laws.

2. Intellectual Property Rights

Enegma owns all Content and Marks. Users receive a non-exclusive, non-transferable, revocable licence for internal business purposes only. Commercial use requires written permission.

3. User Representations

Users warrant they are 18+, provide accurate information, comply with laws, and won't use automated access or illegal purposes.

4. User Registration

Users must maintain password confidentiality and report unauthorized account access immediately.

5. Purchases and Payment

Accepted methods include Visa, Mastercard, American Express, UPI, Razorpay, Stripe, and bank transfers. Pricing in INR or USD.

6. Subscriptions

Auto-renewal occurs unless cancelled. Changes to fees follow applicable legal notice requirements.

7. Cancellation and Refunds

30-day pro-rated refunds available from initial purchase. Requests after 30 days ineligible. Processing takes 10-14 business days.

8. Prohibited Activities

Banned activities include:

• Data scraping
• Fraud
• Circumventing security
• Harassment
• Reverse engineering
• Spam
• Impersonation
• Competitive use

9-10. User Contributions & Licensing

Users retain ownership of submissions but grant Enegma unrestricted rights to use contributions. Users assume responsibility for content legality and accuracy.

11. Services Management

Enegma reserves rights to monitor, restrict access, remove content, and manage operations without liability.

12. Privacy Policy

Services hosted in India. Continued use constitutes consent to data transfer and processing there. See our Privacy Policy for details.

13. Term & Termination

Enegma may terminate access without notice or liability for any reason. Users cannot create replacement accounts.

14. Modifications & Interruptions

Service modifications permitted without notice. No liability for downtime or discontinuance.

15. Governing Law

Governed by Indian law. Maharashtra courts have exclusive jurisdiction.

16. Dispute Resolution

Parties attempt 30-day informal negotiation first. Disputes then go to binding arbitration under India's Arbitration and Conciliation Act, 1996, with one arbitrator in Mumbai.

17. Corrections

Enegma may correct errors and update information anytime without notice.

18. Disclaimer

Services provided "AS-IS." Enegma disclaims all warranties and assumes no liability for errors, personal injury, unauthorized access, interruptions, viruses, or content losses.

19. Limitations of Liability

Liability capped at amounts paid in prior 3 months. No liability for indirect, consequential, or punitive damages, subject to Indian law exceptions.

20. Indemnification

Users defend and indemnify Enegma against third-party claims arising from service use, breach, or harmful conduct.

21. User Data

Users bear sole responsibility for data transmitted. Enegma assumes no liability for data loss or corruption.

22. Electronic Communications

Users consent to electronic delivery and electronic signatures, contracts, orders, and other records.

23. Miscellaneous

These terms constitute the entire agreement. Severability clause applies. No joint venture created.
